Asunción, Agencia IP.- In a significant legal victory, the Attorney General’s Office (PGR) has successfully defended the Paraguayan State against a lawsuit filed by Tagua Pilot, seeking compensation of USD 2,810,800 for actual damage, loss of profits, and loss of opportunity.
Tagua Pilot’s complaint was brought against the Paraguayan State, citing alleged misconduct by Mr. Jorge Mancuello Benítez in his capacity as Naval General Prefect.
The company Tagua Pilot claimed ownership of the tugboat «Espartano.» It argued that the then Naval General Prefect sanctioned Vessel Atlantica S.A. for the irregular transfer of the tugboat «Espartano.» Although the Prefecture later revoked the sanction, the time between the sanction and its revocation allegedly caused economic harm to the tugboat «Espartano,» preventing its commercial exploitation until the lifting of the precautionary mooring measure.
The company asserted the material impossibility of commercially operating the tugboat, estimating the economic damages in the mentioned multimillion-dollar sum and 1.7% monthly interest.
During the trial, the PGR argued that Tagua Pilot S.A. failed to prove ownership of the tugboat «Espartano» and did not justify why the Paraguayan State should be held responsible. The PGR also maintained that the Paraguayan State cannot be held responsible for the claimed amount.
Following due process and thanks to the procedural efforts of the PGR, the court issued a verdict rejecting the lawsuit.
It is noteworthy that the total savings for the Paraguayan State amount to USD 5,295,547, considering the interest calculation requested by the plaintiff when initiating the lawsuit.
The prosecution was led by deputy prosecutors Neri Fleitas and Fabián Almada.
